However, it seems that many journalists do not understand the nature of Anonymous and its structure (or absence thereof). They frequently use the term "Hacker Group", but this is actually not right.&lt;br /&gt;&lt;br /&gt;I would prefer the term "Fluid Organization" to describe Anonymous. A fluid organization is constantly evolving with regard to its structure and its members. There are no clear borders, no defined hierarchies. And for what? For exercising his right to freedom of speech.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family: inherit;"&gt;For many years, he has criticized the Iranian regime. In recent years, he has been rather positive to the regime. Here is the feedback I provided on the paper:&lt;br /&gt;&lt;/span&gt;&lt;blockquote&gt;Unity of command is one of the 14 principles of management defined by Henry Fayol. It has been a basic principle in organization design for a long time, and has been debated controversially. Concepts such as matrix, process-, or network-organizations have been proposed as more agile alternatives. However, when it comes to military organizations, those (post-)modern approaches seem to have clear limitations. The paper demonstrates that lack of unity of command in the Afghanistan theater is one road block to success. The conclusion, to rectify command and control structures and re-focus on unity of command seems evident. Maybe, also some other principles that Fayol defined should be remembered, such as Unity of Drection.&lt;/blockquote&gt;Just as a reminder ... Here are the 14 principles of management as defined by Henry Fayol:&lt;br /&gt;&lt;ol&gt;&lt;li&gt;Division of work. This principle is the same as Adam Smith's  'division of labour'. Specialisation increases output by making  employees more efficient.&lt;/li&gt;&lt;li&gt;Authority. Managers must be able to give orders. Authority gives  them this right. Note that responsibility arises wherever authority is  exercised.&lt;/li&gt;&lt;li&gt;Discipline. Employees must obey and respect the rules that govern  the organisation. Good discipline is the result of effective leadership,  a clear understanding between management and workers regarding the  organisation's rules, and the judicious use of penalties for infractions  of the rules.&lt;/li&gt;&lt;li&gt;Unity of command. Every employee should receive orders from only one superior.&lt;/li&gt;&lt;li&gt;Unity of direction. Each group of organisational activities that  have the same objective should be directed by one manager using one  plan.&lt;/li&gt;&lt;li&gt;Subordination of individual interests to the general interest. The  interests of any one employee or group of employees should not take  precedence over the interests of the organisation as a whole.&lt;/li&gt;&lt;li&gt;Remuneration. Workers must be paid a fair wage for their services.&lt;/li&gt;&lt;li&gt;Centralisation. Centralisation refers to the degree to which  subordinates are involved in decision making. Whether decision making is  centralised (to management) or decentralised (to subordinates) is a  question of proper proportion. The task is to find the optimum degree of  centralisation for each situation.&lt;/li&gt;&lt;li&gt;Scalar chain. The line of authority from top management to the  lowest ranks represents the scalar chain. Communications should follow  this chain. However, if following the chain creates delays,  cross-communications can be allowed if agreed to by all parties and  superiors are kept informed.&lt;/li&gt;&lt;li&gt;Order. People and materials should be in the right place at the right time.&lt;/li&gt;&lt;li&gt;Equity. Managers should be kind and fair to their subordinates.&lt;/li&gt;&lt;li&gt;Stability of tenure of personnel. High employee turnover is  inefficient. Management should provide orderly personnel planning and  ensure that replacements are available to fill vacancies.&lt;/li&gt;&lt;li&gt;Initiative. Employees who are allowed to originate and carry out plans will exert high levels of effort.&lt;/li&gt;&lt;li&gt;Esprit de corps. The problems related to matrix-style organizations, such as the inherent conflict between the two dimensions (LoB vs projects), are well known to organizational researchers and practitioners alike.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;Basically, a matrix organization is a project-type structure that is superimposed on a functional structure. It is often used in organizations where certain expertise must be grouped for complex short- or long-term projects. Teams are formed with staff assigned from functional units, and when the initiative is complete, people would return to their respective groups.&lt;/span&gt;&lt;span style="font-size: 100%;"&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;The idea of the matrix organization is to maintain the characteristics of classical design (division of labor, centralization of authority, unity of control, and unity of direction) while adding the flexibility to work on critical projects.&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;  &lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;However, using a matrix approach might render conflicts between the different dimensions and these conflicts might include disputes about budgets and funding, authority, control, and accountability. And things get worse, if there are not only 2 dimensions, but even more, thus turning the matrix into a n-dimensional vector.&lt;br /&gt;&lt;br /&gt;This can be exemplified by the United Combatant Commands (UCCs) in the US Armed Services.&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;  &lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;A UCC is a joint military command consisting of forces from two or more service branches (Air Force, Army, Navy, Marines). The purpose of establishing UCCs was to provide a more effective command and control structure where coordination and collaboration across branches was required either at functional or geographical level.&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;  &lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;Consequently, UCCs can have a geographical (AFRICOM, EUCOM, CENTCOM, ...) or functional (STRATCOM, SOCOM, TRANSCOM) focus. The UCCs also report directly to the JCS (Joint Chiefs of Staff), and not into any of the branches' command structures. A special role is played by SOCOM (Special Operation Command), which is the only UCC with acquisition authorities.&lt;/span&gt;&lt;span style="font-size: 100%;"&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;USSOCOM oversees the training, doctrine, and equipping of all U.S. SOF (Special Operations Forces) units and was established in 1986/87 in response to concerns about the status of SOF within defense planning. In particular, the experiences from operational shortcomings due to lack of coordination between SOF units from different services and the potential funding conflicts between SOFs and regular forces within the services resulted in Congressional measures to strengthen the SOF position. USSOCOM is headquartered at MacDill Air Force Base in Tampa, FL. USSOCOM has approximately 54,000 active duty, Reserve and National Guard Soldiers, Sailors, Airmen, Marines and Department of Defense (DOD) civilians assigned to the headquarters, its four components and one sub-unified command, and has an annual budget of ~8.5 b$.&lt;/span&gt;&lt;span style="font-size: 100%;"&gt; (Source: SOCOM presentation)&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;SOCOM command structure&lt;/span&gt; &lt;span style="font-family: arial; font-size: 100%;"&gt;&lt;a href="http://3.bp.blogspot.com/_n5vJj6IfA9Y/TI-LxTOwUSI/AAAAAAAAABU/ToAjtmCabNY/s1600/SOCOM+structure.png" onblur="try {parent.deselectBloggerImageGracefully();} catch(e) {}"&gt;&lt;img alt="" border="0" id="BLOGGER_PHOTO_ID_5516781747644158242" src="http://3.bp.blogspot.com/_n5vJj6IfA9Y/TI-LxTOwUSI/AAAAAAAAABU/ToAjtmCabNY/s400/SOCOM+structure.png" style="display: block; height: 312px; margin: 0px auto 10px; text-align: center; width: 400px;" /&gt;&lt;/a&gt;&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;  As depicted above, SOCOM has four subordinated commands that comprise the SOFs coming from the different branches (AFSOC - Air Force, ASOC - Army, NAVSOC - Navy, MARSOC - Marines) and a joint subcommand (JSOC), containing the so called special mission units (SMUs), most notably Army 1st SPF Operational Detachment Delta (aka Delta Force &lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%; font-style: italic;"&gt;or&lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt; Combat Applications Group) and DEVGRU (Naval Special Special Warfare Development Group). In addition, there are regional Special Operations Commands attached to the regional UCCs (e.g. SOCEUR - Special Operations Command Europe attached to EUCOM - European Command).  This means, in peacetime there are three dimensions to the organizational structure of SOCOM: The SOCOM internal command structure, the regional UCCs, and the service branches. This already brings up a variety of questions, such as: &lt;/span&gt;&lt;br /&gt;&lt;ul&gt;&lt;li&gt;&lt;span style="font-size: 100%;"&gt;Are SOFs that are located in specific regions under the primary command of SOCOM or the regional UCC?&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span style="font-size: 100%;"&gt;How are commands over CJSOTFs (Combined Joint Special Operations Task Forces, i.e. SOF Task Forces with members from different branches) distributed to give each branch a "fair share" of the available commands and related promotion opportunities?&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span style="font-size: 100%;"&gt;How can it be ensured that SOF capabilities within the different service components do not overlap, but are developed in a complementary way?&lt;/span&gt;&lt;/li&gt;&lt;/ul&gt;&lt;ul style="font-family: arial;"&gt;&lt;/ul&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;These kinds of issues are debatable and in peacetime, they are interesting topics for meetings. However, if theater operations are taken into account, they are becoming critical to operational success. Considering that there are additional theater specific command structures, as seen in Afghanistan with the CFSOCC-A (Combined Forces Special Operations Component Command) and the CJOSTF-A (Combined Joint Operations Task Force), there are four dimensions to the SOF organizational structure.&lt;br /&gt;&lt;br /&gt;Four dimensions influencing SOF in Afghanistan&lt;/span&gt;&lt;br /&gt;&lt;div class="separator" style="clear: both; text-align: center;"&gt;&lt;a href="http://4.bp.blogspot.com/_n5vJj6IfA9Y/TKSxmMoG5BI/AAAAAAAAABk/vlKAF0Tfd34/s1600/SOCOM+command+structure.png" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"&gt;&lt;img border="0" height="193" src="http://4.bp.blogspot.com/_n5vJj6IfA9Y/TKSxmMoG5BI/AAAAAAAAABk/vlKAF0Tfd34/s320/SOCOM+command+structure.png" width="320" /&gt;&lt;/a&gt;&lt;/div&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-size: 100%;"&gt;The above graphic does not take into account the fact that SOFs might need to coordinate with other, non-SOFs, and coalition forces and commands &lt;/span&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt;at theater level.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: arial; font-size: 100%;"&gt; &lt;br /&gt;It seems obvious that, with this kind of multi-dimensional structure, it becomes increasingly difficult to set-up clear command and control (C2) structure and to establish operational efficiency and effectiveness.&lt;br /&gt;&lt;br /&gt;BTW, the Strategies Studies Institute has published an interesting article on the problem of unified command structures, or rather the lack thereof, in Afghanistan. I had no knowledge of this paper when I wrote this post, but obviously the author has similar concerns. Also the CIO business expectations for 2009 indicate that cost containment is on the rise. Improving business processes has been the #1 priority since 2006, but for 2009, rank 2 and 3 are occupied by cost reduction and workforce effectiveness.&lt;br /&gt;&lt;br /&gt;This is also reflected in our client interactions, where cost reduction measures have become a frequent discussion topic. We therefore developed an approach to quickly identify savings potentials on the basis of comparing a reduced set of key metrics of a client organization with peer group data. Is this something to be puzzled about? Not really.&lt;br /&gt;&lt;br /&gt;Over the past years, many organizations have become quite good at improving their development and service management processes by applying frameworks and standards like ITIL and ISO XXXX. But, for demand management and project portfolio management, being crucial processes prior to development and operations, there are no real standards or generally accepted best practices. The story unfolded like this:&lt;br /&gt;&lt;a href="http://instant-science.blogspot.com/2008/04/dsl-upgrade-disappointed-by-telekom.html"&gt;dsl-upgrade-disappointed-by-telekom&lt;/a&gt;&lt;br /&gt;&lt;a href="http://instant-science.blogspot.com/2008/05/instant-science-dsl-upgrade.html"&gt;instant-science-dsl-upgrade.html&lt;/a&gt;&lt;br /&gt;About two weeks after the letter from Telekom's Board of Management support, I received a call, telling me that they had taken the following measures:&lt;br /&gt;&lt;LU&gt;&lt;br /&gt;&lt;LI&gt;For the router invoice, a credit voucher had been issued.&lt;/LI&gt;&lt;br /&gt;&lt;LI&gt;The law firm had been contacted to withdraw their claim&lt;/LI&gt;&lt;br /&gt;&lt;/LU&gt;&lt;br /&gt;When returning home from my business trip later that week, I indeed had a credit voucher and a letter from the law form in my mail box. Well, my mood didn't get better when I received a letter from a lawyer that claimed around 34 € in the name of Deutsche Telekom, but without actually explaining where this amount comes from and how it is composed. I assume that this is rather irregular from a legal perspective.&lt;br /&gt;&lt;br /&gt;Consequently, I sent a letter to the law firm, asking for proof that he actually acted in the name of Telekom and also requiring a more detailed explanation of the claim. Some research on the net also indicated that the law firm is well-known, maybe one could say notorious, for its behavior. There seem to be thousands of complaints in various blogs and forums. Just search for "Seiler &amp; Kollegen" and you will be surprised.&lt;br /&gt;&lt;br /&gt;And, since I really was in a good mood, I also wrote a letter of complaint to Mr. Timotheus Höttges. Mr. Höttges is member of the board of management of Deutsche Telekom and also responsible for T-Home and Sales &amp; Service. I am really looking forward to receiving a reply.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;UPDATE 05-06-08&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;I received a reply to my letter to Mr. Höttges, Deutsche Telekom's BoM member being responsible for Sales and Service. The list contains a considerable number of items which obviously make little sense in an airplane, such as explosives, guns, etc.&lt;br /&gt;&lt;br /&gt;However, there are also some items that confused me. Why should a golf club be harmful? Have you ever tried to swing a golf club in an airplane? think it might be difficult to use it as an effective weapon.&lt;br /&gt;&lt;br /&gt;The list also contains martial arts equipment and list some examples, such as shuriken and nunchakus, and kubatons. However, it also contains an item called "kubasaunt" and honestly, spoken, I have no idea what this might be. I am tempted to believe that the EASA doesn't know either and the term just ended up there as the result of a mistake. Consequently, I sent the following note to the EASA, asking for a clarification:&lt;br /&gt;&lt;p style="font-style: italic;" class="MsoNormal"&gt;&lt;span style="font-family:Arial;font-size:85%;"&gt;&lt;span style="font-size: 10pt; font-family: Arial;"&gt;Sehr geehrte Damen und  Herren,&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-style: italic;" class="MsoNormal"&gt;&lt;span style="font-family:Arial;font-size:85%;"&gt;&lt;span style="font-size: 10pt; font-family: Arial;"&gt;in Ihrer Verordnung EG 68/2004 vom  01.02.2004 werden Gegenstände aufgelistet, deren Verbringung in ein Flugzeug aus  Gründen der Flugsicherheit nicht zulässig ist.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-style: italic;" class="MsoNormal"&gt;&lt;span style="font-family:Arial;font-size:85%;"&gt;&lt;span style="font-size: 10pt; font-family: Arial;"&gt;Unter Abschnitt 1 - Punkt 3 (Stumpfe  Gegenstände) werden auch Kampfsportausrüstungsgegenstände aufgeführt, darunter  „Kubasaunts“.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-style: italic;" class="MsoNormal"&gt;&lt;span style="font-family:Arial;font-size:85%;"&gt;&lt;span style="font-size: 10pt; font-family: Arial;"&gt;Dieser Gegenstand ist mir, im  Gegensatz zum ebenfalls genannten Kubaton, unbekannt. Until February this year, I had a 6 mbit connection with DSL and phone flatrate and I virtually never had any problem with regard to availability. The cost was maybe somewhat higher than with some competitors, but the service lovel made me stay.&lt;br /&gt;&lt;br /&gt;Then I was called by a customer representative and offered an upgrade from 6 -&gt; 16 mbit, in combination with a hotspot flatrate. The flipside was a 2 year contractual obligation, but I considered this as acceptable.&lt;br /&gt;&lt;br /&gt;A few days later I received the order conformation and another couple of days later the DSL connection was dead. When calling the service center I had to learn that my DSL modem was not capable of a 16 mbit connection and that I would need a new one at the cost of 49 €. I was also told that the cost could be offset against my monthly fee, since I had not been informed about the additional cost.&lt;br /&gt;&lt;br /&gt;A few days later, I received the new modem that nowadays is combined with a wireless access point, installed it and functionality was thus restored. I then sent a mail to Telekom customer service, told them about the issue and asked how to handle the refund/offset. I also told them that I would not pay the invoice for the port, until the issue was settled.&lt;br /&gt;&lt;br /&gt;Today, I received a call where I was told that a refund or offset is out of question and that I should pay the invoice. The reason given was that 49 € is the price and since they could not confirm that I had not been informed about the fact that I would need a new port, there was no reason to waive the invoice.&lt;br /&gt;&lt;br /&gt;I then tried to revoke the upgrade. No, this wasn't possible either since the cancellation period is two weeks. This despite the fact that I had contacted them regarding the issue within this period and the handling time caused the delay.&lt;br /&gt;&lt;br /&gt;Well, what I am supposed to do now? Probably send a harsh letter to Telekom manangement, try to enforce the revocation of the contract and then change the provider. The law forces telcos and ISPs to store any connection data for six months and to make it available to law enforcement organisations (police, prosecutors) upon request. The court has ruled that this data only needs to be made available in the case of capital crimes. The final decision is expected to be taken later this year.&lt;br /&gt;&lt;br /&gt;Some time ago, the German Minister of Justice commissioned an investigation regarding the legal aspects of the planned data retention law. Obviously, the result was not the desired one and the publication has been slowed for quite some time, while requests regarding the publication of an &lt;a href="http://www.vorratsdatenspeicherung.de/images/mpi-gutachten.pdf"&gt;intermediate version&lt;/a&gt; have been refused by the ministry.&lt;br /&gt;&lt;br /&gt;It is astonishing, how frequently the "law and order" politicians in the German government are slapped by the constitutional court. When starting to prepare the keynote I realized that the term EIM is used in a rather inconsistent way by users and vendors alike. But, as some of my colleagues stated: for companies to manage their information assets better, they need to clearly understand the term enterprise information management and its meaning. And, they also came up with a definition:&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style:italic;"&gt;Enterprise information management (EIM) is an integrative discipline for structuring, describing and governing information assets, regardless of organizational and technological boundaries, to improve operational efficiency, promote transparency and enable business insight.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;This definition is comprehensive and covers the most important elements of EIM. But, although it is a one sentence definition, I was looking for something even shorter. How do you like this one:&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style:italic;"&gt;EIM is the just-in-time concept for information.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;blockquote&gt;Unfortunately, the conference was cancelled due to a small number of participants. He is now working as a consultant in the Service Management area.&lt;br /&gt;&lt;br /&gt;That made me think about a proposal I am working on. The client has established ITIL-processes and they seem to work well, but still there are issues regarding the collaboration with the business side.&lt;br /&gt;&lt;br /&gt;It seems that the client, and for this matter also many other organizations, has invested considerable resources in establishing Service Management processes, but mainly on the deliver side. It was nice, because he did not send a simple connect request, but a longer message that also contained some interesting thoughts on social networking.&lt;br /&gt;&lt;br /&gt;This, in turn, made me think of a phenomenon I could observe over the last 2 days. My son (age 16) spend quite some time video-chatting with a female class-mate. The interesting thing is that the walking distance is just 10 minutes.&lt;br /&gt;&lt;br /&gt;Clearly, social networking can enable reconnects with old friends. The "cheers to absent friends" might become less frequent, if you can connect them remotely. I use Skye, Facebook etc. to keep in touch.&lt;br /&gt;&lt;br /&gt;On the other hand, social networking on the net also has a potential to change social patterns. Instead of visiting each other, we could chat or skype. Several Scientology web sites have been under attack and grounded for some time, while others are online. At the same time, the attack on the sites, wikis and IRC channels being used for coordinating Anonymous' activities, performed under the name "The Regime", have caused them to build a new defense line. By now, this seems to work and the sites are online and by now also local ones, e.g. in Germany, have emerged.&lt;br /&gt;&lt;br /&gt;By now, Anonymous is planning continued cyber-attacks, but also IRL activities, such as prank calls to Scientology establishments and members, and on-site demonstrations are taking place.&lt;br /&gt;&lt;br /&gt;It should also be noted that Anonymous is not, as it has been widely reported, a group of hackers, but a loosely coupled network of people without a clear structure and governance, sharing a cause. In other words, Anonymous is structurally close to the internet itself.&lt;br /&gt;&lt;br /&gt;This is, on the hand hand, a clear advantage. Since loosely coupled groups without central governance can operate independently and quickly regroup, taking out a node of the network will not harm the superstructure. On the other hand, they are more difficult to control and direct. In addition, Anonymous is based on the engagement of volunteers that might not be enduring.&lt;br /&gt;&lt;br /&gt;The strength of Anonymous is therefore also its weakness. A user has published a video on Youtube, in which group calling itself "Anonymous" (nomen est omen!) declares its will to destroy the CoS. It seems that some DDoS attacks on CoS webservers already took place. My topic was Portals of the Future and I claimed, among other things, that Web 2.0 software would become an integral part of corporate information management. In this context, I also asked the participants whether they have accounts on social networking sites, e.g. Facebook of MySpace. It was a real surprise, when only 2 or 3 participants raised their hands. I had expected a considerably higher diffusion. &lt;br /&gt;&lt;br /&gt;I also recommended to set up a governance structure for current and future portal initiatives and asked, whether this or a general governance already existed. Again, very few hands were raised. The law incorporates the principles of the EU Data Retention Directive, that is the mandatory retention of all telecoms traffic data for law enforcement purposes.&lt;br /&gt;&lt;br /&gt;In brief, starting in 2008, all providers of telecommunication services and ISPs are required to store the connection data of their customers for 6 months and to make it available to law enforcement agencies upon request.&lt;br /&gt;&lt;br /&gt;Traffic data to be stored includes a variety of information - sender and recipient of emails, phone numbers of callers and recipients for each phone call, etc. In addition, the use of anonymization services will be forbidden.&lt;br /&gt;&lt;br /&gt;I strongly object this law, since I consider it as being an intrusion into my and other citizens privacy. We came to discuss about one of my favourite topics, Business Process Management&lt;br /&gt;&lt;br /&gt;They were telling me that they had no real understanding of the business processes in their organization, but that some consultants were now doing a process analysis and mapping everything in visio files.&lt;br /&gt;&lt;br /&gt;At that point I became a little irritated and told them that I consider it as management malpractice to be process-ignorant and that hiring consultants to paint visio-charts wouldn't make things better. Instead, they should aim for a holistic BPM approach and use a platform that is more than a painting tool. I believe that publishing a rather management science oriented article is also something new for this kind of publication, so I am curious about the review.&lt;br /&gt;&lt;br /&gt;Well, I am also very satisfied with my new job. Interesting people, and challenging high-profile projects. The first quarter brought projects in Germany, Italy, and Sweden. Including myself, there have have been four speakers that have proposed that, in many change initiatives, it is not middel management that hampers change. On the contrary, middle management often welcomes the attempt to improve things and is close enough to the operational business to know about shortcomings and improvement potentials.&lt;br /&gt;&lt;br /&gt;Obviously, it seems to be between executive management and middle management where you can find the roadblocks. Senior managers, stating "This is a nice idea. Why don't you go ahead and work with it? And please, don't bother me too much with this stuff in the future!"&lt;br /&gt;&lt;br /&gt;What is this supposed to mean? Is it rejection? Not really. Is it support? Hardly. The CEO delivered a short speech and removed the cover from the new "Welcome to Nycomed" sign at the entry to the Constance premises.&lt;br /&gt;&lt;br /&gt;Formally, the new company has existed for about 2 weeks now and the integration activities have been initiated already in virtually all departments. So far, however, very little was actually communicated with regard to the future organization structure.&lt;br /&gt;&lt;br /&gt;The integration and harmonization of the different business processes that exist within the two "old" departments is also going to be a considerable challenge. The letter came from a lawyer with the name of Olaf Tank in the name of a company called A &amp; M Schmidtlein GbR. Some web research revealed, that this seems to be a scam and that those guys, in mascopy with the lawyer, have established a well-working money making machine by scaring internet-users to pay their regularly unjustified claims. There seem to be thousands of complaints and reports filed with the police and prosecution authority.&lt;br /&gt;&lt;br /&gt;I sent the following letter (in German) to O. Tank, Esq and I also filed a complaint with the chamber of lawyers (Anwaltskammer) in Oldenburg, which is the competent chamber for Mr. Tank. For the reply, please scroll down.&lt;br /&gt;&lt;br /&gt;---&lt;br /&gt;&lt;br /&gt;Sehr geehrter Herr Tank,&lt;br /&gt;&lt;br /&gt;vielen Dank für Ihr Schreiben. Ich nehme hierzu wie folgt Stellung:&lt;br /&gt;&lt;br /&gt;Die von Ihnen genannte Web-Adresse P2P-heute.com ist mir unbekannt und wurde von mir nie besucht.&lt;br /&gt;&lt;br /&gt;Zur Untermauerung Ihrer Forderung wollen Sie mir bitte folgende Unterlagen zusenden:&lt;br /&gt;&lt;br /&gt;1. Nachweis des Internetproviders, dass die von Ihnen genannte Anmelde-IP zu dem von Ihnen genannten Zeitpunkt mir zugewiesen war.&lt;br /&gt;&lt;br /&gt;Desweiteren fordere ich Sie auf, mir innerhalb von 2 Wochen offenzulegen, welche personenbezogenen Daten Sie, bzw. Ihre Mandantschaft, über meine Person gespeichert haben.&lt;br /&gt;&lt;br /&gt;Ich behalte mir vor, rechtliche Schritte bezüglich der an mich gestellten Forderungen, sowie nach Ablauf der Ihnen gesetzten Frist wegen möglicher Verletzung des Bundesdatenschutzgesetzes, gegen Sie, bzw. Ebenso die Mahnung vom 22.10.2006.&lt;br /&gt;&lt;br /&gt;Des Weiteren hat eine Verifizierung der Anmeldung über die genannte Mailadresse stattgefunden.&lt;br /&gt;&lt;br /&gt;Ihre Stellungnahme werten wir als Zahlungsverweigerung. In the following, I have transcribed the letter in German.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;---&lt;br /&gt;Sehr geehrter Herr Simon,&lt;br /&gt;&lt;br /&gt;wir bestätigen den Eingang Ihrer o.g. E-Mail.&lt;br /&gt;&lt;br /&gt;Zu den Aufgaben der Kammer dürfen wir zunächst auf folgendes hinweisen:&lt;br /&gt;&lt;br /&gt;Ein Rechtsanwalt ist gemäss § 43 der Bundesrechtsanwaltsverordnung (BRAO) verpflichtet, seinen Beruf gewissenhaft auszuüben. Er hat sich innerhalb und ausserhalb des Berufs der Achtung und des Vertrauens, welche die Stellung des Rechtsanwalts erfordert, würdig zu erweisen. Die Überwachung dieser Pflichten obliegt gemäss § 73 Abs. 2 Nr. 4 BRAO dem Vorstand der Rechtsanwaltskammer. Die Kammer kann nur im Rahmen dieser gesetzlichen Regelung tätig werden.&lt;br /&gt;&lt;br /&gt;Es gehört nicht zu den Aufgaben der Rechtsanwaltskammer die Interessen einzelner Beschwerdeführer gegenüber dem Rechtsanwalt zu vertreten und deren Belange durchzusetzen. Die Kontrollfunktion dient vielmehr dem öffentlichen Interesse an einem geordneten Recht und Gesetz entsprechenden Ablauf der Rechtspflege. Die Kammer kann im Wege der Aufsicht nur tätig werden, wenn der Rechtsanwalt gegen seine Berufspflichten verstossen hat. Dabei ist sie im Hinblick auf die Stellung des Rechtsanwalts als unabhängiger Berater und Vertreter in allen Rechtsangelegenheiten (§§ 1, 3 BRAO) nicht befugt seine Handlungen auf inhaltliche Richtigkeit und Zweckmässigkeit zu überprüfen. Diese Grenzen hat die Rechtsanwaltskammer zu beachten.&lt;br /&gt;&lt;br /&gt;Bei einem Verdachtsfall strafbaren Verhaltens steht jedem Bürger das Recht der Strafanzeige frei. Es ist die Aufabe der Strafverfolgungsbehörden, die erforderlichen Ermittlungen zu führen.&lt;br /&gt;&lt;br /&gt;In dem vorliegenden Fall geht es im Kern um das Verhalten des Auftraggebers des Rechtsanwalts, der Firma Schmidtlein und evtl. weiterer Firmen. Es ist zunächst Aufgabe der Strafverfolgungsbehörden zu prüfen, ob das Geschäftsgebaren der Fa. Deswegen hat die Rechtsanwaltskammer die Generalstaatsanwaltschaft Oldenburg unterrichtet, die nach der Bundesrechtsanwaltsodnung die Ermittlungen in anwaltsgerichtlichen Verfahren führt. Die Generalstaatsanwaltschaft hat ihrerseits die zuständige Staatsanwaltschaft unterrichtet.&lt;br /&gt;&lt;br /&gt;Die Möglichkeiten der Rechtsanwaltskammer selbst sind damit einstweilen erschöpft. Es bleibt zunächst abzuwarten, zu welchem Ergebnis die Ermittlungen der Strafverfolgungsbehörden führen. Wird ein strafbares Verhalten festgestellt, obliegt es der Generalstaatsanwaltschaft zu prüfen, ob weitere Massnahmen, z. When the BPM Team started its work in September last year, there was a considerable number of process descriptions at a highly granular level, but little at medium- or top-level. As a consequence, it was rather difficult to develop a comprehensive picture of business processes that spans over various functions.&lt;br /&gt;&lt;br /&gt;I have had several discussions with my boss regarding the mandate for developing the process map. It is my clear opinion that the development of a top-down map, starting at  level 0, also requires an appropriate mandate by the executive board. Otherwise, it becomes considerably difficult to get the necessary support in the business units. I also tend to claim that this is "good practice" and after all, everybody teaches you at universities and conferences.&lt;br /&gt;&lt;br /&gt;My boss, on the other hand, keeps telling me that this only happens in an ideal world and that we have to manage without a board decision, but that all VPs were informed about the initiative. Given that this is true, how do you actually determine where change is about to take place?&lt;br /&gt;&lt;br /&gt;If you have your as-is and to-be processes properly defined and documented, you can use the process documentation as the basis for defining the change management plan. For each role, the current and future tasks can be identified, including the use of specific IT systems to support the performance of these tasks. There are still some open question, the most important being: Does chapter 12.2.2 of the ICH E3 Guideline require an interpretative narrative, i.e. an assessment of each individual Adverse Event, similar to those in the CIOMS form?&lt;br /&gt;&lt;br /&gt;This question boils down to the interpretation of section 12.3.2 and 12.3.3. According to my opinion, which is supported by some colleagues, it is sufficient to include a non-interpretative narrative in 12.3.2 and to have all interpretation in section 12.3.3.&lt;br /&gt;&lt;br /&gt;In addition, the following questions also need to be addressed:&lt;br /&gt;&lt;ul&gt;&lt;br /&gt;&lt;li&gt;Is a review required, when the process for creating auto-generated narratives is validated?&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Are all items to become part of the auto-generated narrative to be reconciled?&lt;/li&gt;&lt;br /&gt;&lt;/ul&gt;&lt;br /&gt;&lt;br /&gt;Here is the original text from the ICH E3 Guideline:&lt;br /&gt;&lt;br /&gt;&lt;b&gt;12.3.2 Narratives of Deaths, Other Serious Adverse Events and Certain Other Significant Adverse Events&lt;/b&gt;&lt;br /&gt;There should be brief narratives describing each death, each other serious adverse event, and those of the other significant adverse events that are judged to be of special interest because of clinical importance. These narratives can be placed either in the text of the report or in section 14.3.3, depending on their number. Events that were clearly unrelated to the test drug/investigational product may be omitted or described very briefly. In general, the narrative should describe the following: the nature and intensity of event, the clinical course leading up to event, with an indication of timing relevant to test drug/investigational product administration; relevant laboratory measurements, whether the drug was stopped, and when; countermeasures; post mortem findings; investigator's opinion on causality, and sponsor's opinion on causality, if appropriate.&lt;br /&gt;In addition, the following information should be included:&lt;br /&gt;&lt;ul&gt;&lt;br /&gt;&lt;li&gt;Patient identifier&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Age and sex of patient; general clinical condition of patient, if appropriate&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Disease being treated (if the same for all patients this is not required) with duration (of current episode) of illness&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Relevant concomitant/previous illnesses with details of occurrence/duration&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Relevant concomitant/previous medication with details of dosage&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Test drug/investigational product administered, drug dose, if this varied among patients, and length of time administered&lt;/li&gt;&lt;br /&gt;&lt;/ul&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;12.3.3 Analysis and Discussion of Deaths, Other Serious Adverse Events and Other Significant Adverse Events&lt;/b&gt;&lt;br /&gt;The significance of the deaths, other serious adverse events and other significant adverse events leading to withdrawal, dose reduction or institution of concomitant therapy should be assessed with respect to the safety of the test drug/investigational product. Particular attention should be paid to whether any of these events may represent a previously unsuspected important adverse effect of the test drug/investigational product. It contains a wide array of master data about clinical studies and supports the organization performing the trial with tregard to managing all activities within the study.&lt;br /&gt;&lt;br /&gt;Since the CTMS is involved in virtually all trial related processes, it also has a considerable number of interfaces. It contains the investigator and ethics committees address data which are e.g. required for sending out Dear Dr. Letters, it mirrors the site visit structure and trigger payments to investigators, etc.&lt;br /&gt;&lt;br /&gt;When replacing a CTMS, it is thus inevitably important to invest an adequate amount of time and resources to analyze the business processes that the CTMS is supposed to support. The process analysis can then also be used to derive functional requirements for the URS.&lt;br /&gt;&lt;br /&gt;Yesterday, I as at the kick-off for a new project, aiming at the revision of our CTMS, and it was clearly stated: First processes, then systems. Most of the content here are listings, but section 12.3.2 requires &lt;i&gt;Narratives of Deaths, Other Serious Adverse Events and Certain Other Significant Adverse Events&lt;/i&gt;.&lt;br /&gt;&lt;br /&gt;A narrative is a brief textual description of the case. An interesting question is, where the content for these narratives comes from and who is supposed to to provide or write it. This could be either the Drug Safety (Pharmacovigilance) unit, or Medical Writing. Drug Safety could argue that the basic ocntent already exists as part of the CIOMS (Council for International Organizations of Medical Sciences) forms that are used for SAE reporting (reporting of Serious Adverse Events) and that have been submitted to the authorities already. On the other hand, Medical Writing could argue that these narratives are too lengthy and elaborated and not suitable for inclusion into the CSR. In addition there might be diverging data elements, such as reference dates.&lt;br /&gt;&lt;br /&gt;A solution might be to use the clinical database to generate the CSR Safety Narratives automatically. One could develop a standard text, which is then filled with database content. This would create narratives that all have the same "look and feel", even though they might render somewhat "mechanic" texts. There are also some advantages:&lt;br /&gt;&lt;br /&gt;&lt;ul&gt;&lt;br /&gt;&lt;li&gt;There are no more data divergence problems, since all data comes from one system. However, it should be checked whether the number of items being subject to reconciliation needs to be increased to ensure that all data being used for creating the narrative from the clinical system is consistent with the corresponding elements in the Drug Safety system.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;The narratives can be kept brief and there is no need for harvesting CIOMS forms. I first questioned, whether it is necessary to perform a Sponsor Causality Assessments (SCA) for all non-serious Adverse Events. The German law "Arzneimittelgesetz" (AMG) requires in § 63b (4):&lt;br /&gt;&lt;br /&gt;&lt;i&gt;Der zuständigen Bundesoberbehörde sind alle zur Beurteilung von Verdachtsfällen oder beobachteten Missbrauchs vorliegenden Unterlagen sowie eine wissenschaftliche Bewertung vorzulegen.&lt;/i&gt;&lt;br /&gt;&lt;br /&gt;The previous sections (§ 63b (1)-(3) talk about &lt;b&gt;Suspected Serious Adverse Reactions&lt;/b&gt;, whereas (4) only refers to &lt;b&gt;Suspected Adeverse Reactions&lt;/b&gt;. I spent yesterday in 2 meetings regarding the information and data flows between the future EDC system (Electronic Data Capture) and the Drug Safety system, and the future CDW (Clinical Data Warehouse).&lt;br /&gt;&lt;br /&gt;The meetins clearly indicated that standards are becomingly increasingly important. The current clinical IT landscape is homegrown and all systems are integrated at database level, thus ensuring referential integrity and ease of transfer. However, some of the advantages will be lost due to the strategy of going for COTS (Commercial off the shelf) software. In addition, using an ASP model, or collaborating with external parties, such as CROs (Contract Research Organizations), require that the exchange mechanisms are clearly defined.&lt;br /&gt;&lt;br /&gt;In the clinical domain, the set of CDISC standards is becoming more widespread. Consequently, we decided that CDISC SDTM is our choice regarding the internal and external transfer of clinical data. On the other hand, within the Pharmacovigilance domain, E2B is commonly used. Unfortunately, no systems speaks all languages and dialects and we do not have a lingua france for this purpose yet. He also asked me, where a BPM CoE should be located in the organization.&lt;/p&gt;&lt;p class="mobile-post"&gt;In many organizations, including ours, the BPM CoE is located within the IT department. Of course, one could argue that this creates a BPM organization that is only remotely connected to the business. On the other hand, there are also good reasons for this set-up:&lt;/p&gt;&lt;p class="mobile-post"&gt;(1) Being cross-functional IT has a perspective that spans across borders within and across the organization.&lt;/p&gt;&lt;p class="mobile-post"&gt;(2) The IT unit has no functional stakes to defend.&lt;/p&gt;&lt;p class="mobile-post"&gt;(3) Since BPM is closely connected to EA (Enterprise Architecture), a close collaboration between these areas is fostered.&lt;/p&gt;&lt;p class="mobile-post"&gt;(4) BPM also requires a level of IT competence that frequently does not reside within the business organization.&lt;/p&gt;&lt;p class="mobile-post"&gt;However, this does not mean that BPM can be run as an initiative by IT alone. After having thought for quite some time about becoming a blogger myself, I finally started it today. Let's see what happens ...&lt;br /&gt;&lt;br /&gt;The meeting also reminded me of the times when I was working as a researcher. The discussions were really inspiring.
